The Commission had declared the election inconclusive due to electoral malpractices.
Mr. Nuhu, a former deputy governor of the state, who polled 92,056 votes to Mr. Umaru’s 87,405 votes, has since taken his seat in the Senate. But the latter challenged the result.
Announcing the bye election was held last August the verdict of the three-member tribunal, its chairman, Justice Ibrahim Bako said Mr. Umaru got 79,779 votes against Mr. Nuhu’s 68,525 votes.
It is not clear if Mr. Nuhu will challenge the result at the Court of Appeal.
If sworn in, Mr. Umaru will only spend four months in the upper legislative chamber. The seat became vacant following the death of its former occupant, Awaisu Kuta.
The outgoing governor of Niger State, Babangida Aliyu, is the PDP candidate for the senatorial district in the February 14 election.
