HOW TO LOOSE ELECTIONS IN A STATE THE BAMANGA TUKUR WAY : Supreme Court Stops Tony Nwoye/PDP From Campaigning In Anambra.


The Supreme Court on Thursday stopped the Peoples Democratic Party (PDP) from kicking off Tony Nwoye’s campaign  billed to come up tomorrow in Anambra State pending when it will determine the appeal brought by one of the contenders to the governorship ticket, Nicholas Ukachukwu challenging the decision of the Court of Appeal which declared Nwoye as the authentic candidate of the party.
Also the court stopped Andy Ubah from joining in the appeal  seeking to decide who the authentic standard bearer of the PDP in Anambra state is, between Tony Nwoye and Nicholas Ukachukwu.
The court, however, fixed Monday to hear the appeal by Ukachukwu.
Counsel for PDP and Nwoye, Paul Erokoro and Garba Pul respectively gave an undertaking that none of their clients will do anything to tamper with the subject matter, so as not to overreach the court.
This was after counsel to Ukachukwu, J.B Daudu notified the court that the party is planning to hand over the flag to Nwoye on Saturday.
It is recalled that the Federal High Court sitting in Port Harcourt had earlier declared Nicholas Ukachukwu as the candidate of the party but this was reversed by the Court of Appeal, Port Harcourt division wherein Tony Nwoye was declared as the authentic candidate. Not satisfied, Ukachukwu through his counsel, J.B Daudu had approached the apex court challenging the judgment of the lower court.
Andy Ubah had earlier through his counsel, Lateef Fagbemi brought an application seeking for leave to be joined as an interested party in the appeal between Tony Nwoye and Nicholas Ukachukwu which will be coming up before the court on Monday.
Joined as respondents are the PDP, Independent National Electoral Commission (INEC), Tony Nwoye and Nicholas Ukachukwu.
Fagbemi hinged his application on ground that it was the recognized state executive of the party that conducted the primary that brought Andy Ubah.
He further submitted that the Federal High Court had earlier given an order that the primary election can only be conducted by the Ejike Ogbeigbo-led executive which the INEC complied with.
He also submitted that the lower court turned down their application to be joined as a party before it, hence the need to seek for joinder before the final decision is reached by the apex court.
Opposing the application, counsel for the PDP, Paul Erokoro submitted that the application is an abuse of court process as the applicant had earlier filed an appeal which has been entered and pending before the court.
He further argued that contrary to the submission of the applicant, the national executive of the party has the power to conduct a congress where a party candidate for a gubernatorial election will emerge.
He, however, prayed the court to dismiss the application.
Counsel for Tony Nwoye, Garba Pul also opposed the application seeking leave stating that the order which the applicant is relying on was given after the primary election had been conducted, submitting that the order could not have a retrospect effect.
He also argued that the application brought by the applicant if granted will delay and complicate the existing appeal of which the court has fixed Monday for hearing.

Governor Adams Oshiomhole of Edo State, yesterday, said a member of the Presidential Advisory Committee on National Dialogue, Col. Tony Nyiam (rtd) has exposed the planned national conference as a fraud, saying excesses of the former army officer showed the conference was being planned to fail. Reacting to Col. Nyiam’s defence of his action, Oshiomhole in a statement by his Chief Press Secretary, Mr. Peter Okhiria said:
“Our attention has been drawn to the lame and odious response of Col Tony Nyiam to his shameful action at the sitting of the Presidential Advisory Committee on National Dialogue in Benin City, on Monday October 28 where he fully exposed his hand as a biased member of a committee which should be above political, ethnic and indeed other sentiments.
“We wonder when Nyiam became the President’s spokesman as to want to drag the President’s name into his shameful act. We are, however, not surprised, going by his antecedents; the Benin incident was just another manifestation of Nyiam’s lack of respect for constituted authority and his love for disunity.
“Nyiam said Governor Adams Oshiomhole was “talking down on the people”. We wonder when airing one’s opinion or saying ‘I believe that the outcome of this conference will not be different from that of other conferences we have had in the past’ means talking down on the people.
“Nyiam deserves our pity. He might still be hallucinating, thinking he is an Army officer who must be obeyed. We recognize that no military officer worth his salt would openly disagree with a superior or a governor at a forum such as the one in Benin City, but again, we recognize that the maxim “Officer and Gentleman” does not apply to Nyiam as he has once again displayed to the people in the open.
“We find it interesting that Nyiam has exposed the undercurrent motive of the conference which has also confirmed Governor Oshiomhole’s initial fears about viability, necessity and desirability of same.


“In as much as we believe that Nigeria is in dire straits, the Governor still insists that a talkshop with no agenda is not necessary at this time.”

Aides of the leaders of the All Progressives Congress (APC), and the defeated Presidential candidate of CPC in 2011, Maj General Muhammad Buhari (rtd), yesterday said the confidence exuded by Bamanga Tukur that Jonathan will rule the country till 2019 when a young turk of northern extraction will take over from, is ploy to secure the votes of the region.

According to them, Maj Gen Buhari, who is being tipped to fly the flag of the APC, discovered before Tukur made his statement that the PDP and the presidency are working secretly to woo the former Chief Security Officer (CSO) to the late General Sani Abacha, Major Hamza Al-Mustapha, to succeed Jonathan in 2019.

This belief by the Buhari camp is an indication that they see 2015 a already going to Jonathan and betrays the defeatist tendency within their camp.

The game plan, one of the sources closed to Buhari, who pleaded anonymity, is to galvanise al-Mustapha to continue to mobilise the people of the North for the PDP.

"At payback time," another source explained, " the former CSO would first of all be made the runningmate of Jonathan or his next National Security Adviser (NSA), preparatory to succeeding his principal."

Some opinions in the North show that some political stalwarts believe that al-Mustapha's release was engineered by Jonathan for political reasons.

The ex-CSO was accused of complicity in the murder of Kudirat Abiola, the wife of the acclaimed winner of the June 12, 1993 presidential election, which was annulled by the military administration then in power.

Since his release, al-Mustapha, has been working closely with ex-Niger Delta militant leader, Mujahid Abubakar Asari Dokubo, to unite Nigerians and mobilise the youths for a yet-to-be stated purpose.

The litmus test of his political popularity was when he staged a rally in Kaduna, the political base of the incumbent Vice-President, Namadi Sambo, despite the latter's behind-the-scene effort to frustrate the gathering.

"We have information on what prompted Tukur to make the statement he made, and we are waiting to see how the deception will play out,"

One source said: "The political strength of Buhari in the North remains strong. I want you to know that much of the deliberations and planning for the registration of members of the APC is being done in his house here in Kaduna."

Equally, it was learnt that in a show of their political immaturity, the Buhari camp believe that the additional five PDP governors that would shift base to the new PDP, in addition to the current G7, would join the APC. Although all these calculations are no more relevant as the Rebel PDP are in a confused state.

A 40-year-old widow identified as Mujidat was caught on Wednesday with a dead day old baby hidden in a sack around her home at 2, Reverend Alimi street, NEPA phase 1, Ijagemo in Iba local council development area of Lagos state.

The mother of five was caught by a high Chief, Babatunde Balogun a member of the community when she was trying to dispose the baby at about 5p.m on Wednesday.
According to report, when Balogun questioned her on the content of the sack, she said it contained household items which bought from the market but when he looked closely, he noticed it was a dead day old baby which the woman had allegedly just delivered.
That was when he raised an alarm calling the attention of other residents.
Mujidat said she didn’t see the need of going to any hospital to deliver as she found delivery easy and therefore claimed to have done everything herself.
It was gathered that different men have been visiting her home after the death of her husband three years ago.
When asked if she planned to throw away the baby because of an alleged paternity mess, she denied, claiming  that a welder turned block maker near her residence was responsible for the pregnancy that resulted in the birth of the dead baby she was caught with. .
Officials of the Community Development Association, CDA, in the area later accompanied the woman and her sack of baby to the Isheri-Oshun Police Division where the matter was reported.
At the time of this report, the woman was still being interrogated.

America is consistently pushing for openness and whistle-blowing as Nigeria goes after officials who expose wrongdoings.
The U.S. Securities and Exchange Commission today announced an award of more than $150,000 to a whistleblower whose tips helped the agency stop a scheme that was defrauding investors.
This is a sharp contrast with the situation in Nigeria where the Nigerian Civil Aviation Authority, NCAA, is hounding an informant who leaked the controversial acquisition of a N255 million armoured cars for Aviation Minister, Stella Oduah
The SEC award recipient, who does not wish to be identified, provided significant information that allowed the SEC to quickly open an investigation and obtain emergency relief before additional investors were harmed.  By law, the SEC must protect the confidentiality of whistleblowers and cannot disclose any information that might directly or indirectly reveal an identity.
The award amount represents 30 percent of the money collected by the SEC in the successful enforcement action, the maximum permitted under the law.
“This is continued momentum and success for the SEC’s whistleblower program that is bringing our investigators valuable and timely information to stop ongoing frauds before additional investors can be harmed,” said Sean McKessy, chief of the SEC’s Office of the Whistleblower.
This is the sixth whistleblower to be awarded through the SEC’s whistleblower program since it began two years ago.  The largest award was announced earlier this month when a whistleblower was awarded more than $14 million.
But in Nigeria, the NCAA has announced it would  go after its official(s) that allegedly leaked the information on the purchase of two armoured vehicles for  Minister Oduah.
Folayele Akinkuotu, the Director General of the Nigeria Civil Aviation Authority, NCAA, stated this at a press conference at the Ministry of Aviation headquarters in Abuja on October 18.
Mr. Akinkuotu said a staff of the ministry who allegedly leaked the information to journalists, was now on the run. He also condemned the leak that exposed the purchase of the two armoured cars for N255 million.
He said he was “shell-shocked’’ that government information regarding the procurement of the two vehicles was obtained illegally and transmitted to the public medium in an “illegal manner’’.
“How you obtain information and how you put it in the public purview can actually be criminal,’’ he said.
The aviation boss said the agency has issued a circular to all the staff, reminding them of the “confidentiality’’ of certain aspects of their work.
The circular read by the director-general in part said: “By the nature of our work and statutory provisions, certain levels of documents, processes and information are required for the successful day-to-day operation.
“For instance, the Civil Aviation Act makes specific provisions with respect to our obligation for confidentiality and restricted access to certain information that we procure in the conduct of our  statutory functions.’’

The Senate Committee on Aviation yesterday said the Federal Airport Authority of Nigeria (FAAN) has confirmed that it purchased 202 vehicles.
It said that FAAN also confirmed that two Lexus Limousines and two Toyota Prado Sport Utility Vehicles (SUVs) are part of the vehicles.
The Committee said FAAN claimed that two of the vehicles were bought for Aviation Minister Stella Oduah while another two were purchased for the FAAN Managing Director, Mr. George Uriesi.
It said some of the vehicles were bought for the use of directors of FAAN.
Uriesi told the committee that the limousines were bought for N60m each.
He however, said he did not have details of the cost of the Prado SUVs.
He told the committee the cars were in the custody of an unnamed bank which funded the purchase of the four top of the range vehicles.
The MD claimed that the Aviation Minister approved the purchase, while somebody whose name  he did not disclose signed on his (Uriesi) behalf.
Chairman, Senate Committee on Aviation, Senator Hope Uzondinma, spoke on the car purchase at the continued Public Hearing on the crisis in the aviation sector.
Uzodinma said,  ”Investigation is still ongoing and it will not be fair for me to preempt it. FAAN did confirm that among the operational vehicles they purchased, four of them are armoured vehicles, two for the MD and two for the minister.
“We told them (FAAN) to go back and put everything in writing and make a comprehensive statements on all vehicles purchased.
“FAAN said they bought a total number of 202 vehicles for different operations. So until they come back on Monday we cannot rush into conclusion. The MD FAAN said they did a funding arrangement with a commercial bank.”
He said his committee would do a thorough investigation of extra-budgetary spending by the agencies in the Aviation Ministry.
According to him,”This investigation will be a very deep one so that at the end of the day, we do a holistic approach and look at how the sector will be repositioned so that all anomalies will be corrected…”

The defence of the Aviation Minister, Princess Stella Oduah at the House of Representatives, Abuja, yesterday.
1.1 Let me first and foremost apologise for my inability to honour your invitation to appear before you on the last day the public hearing held. My non appearance was not borne out of disrespect to this Honourable House. Let me also thank the Honourable Committee for rescheduling my appearance to today.
1.2 The invitation to appear before this Honourable Committee was brought to my attention while I was on national assignment far away in the State of Israel to conclude negotiations and sign a Bilateral Air Service Agreement (BASA) on behalf of our dear country. I received the invitation with gratitude to God because of the promise of the opportunity it would afford me for Nigerians, and indeed the whole world, to hear my own side of the story.
1.3  In her 12-page presentation, Princess Oduah said, “In the last few weeks, I have received all sorts of bashings in the media. So many persons have also risen to my defense. My traducers have abused me, some of them out of a genuine sense of outrage that I allegedly spent the sum of USD1.6 Million of government funds to purchase for myself 2 nos bullet proof BMW Cars for my personal use while millions of Nigerians are unable to afford three square meals daily.

“You may recall that there have been attempts to clarify issues pertaining to this particular procurement. You will also recall that in the process some of the issues were further muddled up.
I mention in this regard the first attempt at clarifying the issue by the Coordinating Spokesperson for the Parastatals who, without recourse to the Minister or the Principal Officers of the Ministry and its Agencies described the information as a mere rumour.
“This was followed by the statement of my S.A Media who was himself guided by his own perception of the duties and challenges of the office of the Minister and possibly, even the danger to the person and office of the Minister.
This is made evident by the fact that his statement focused on the personal security of the Minister without recourse to the procurement process and policy file to which he did not have access; hence a statement that the procurement was for the “safety and security of the Honourable Minister whom he said was facing some imminent threats to her life on account of the reforms in the sector”.
“The last official intervention in this matter came from the Director General of NCAA, the agency charged with the oversight of the aviation sector and the agency that actually undertook the procurement.
Whereas the DG was right in saying that the vehicles were not bought for the Minister, the anticipated positive effect of this correct piece of information was marred by remarks credited to the DG suggesting that the agency was more concerned about issues of administration and information security that had no bearing on this issue. In this regard, we must bear in mind that the DG was very likely guided by the provisions of the Official Secret Act but which I make bold to state before you must not take precedent over the Freedom of Information Act or the powers of the National Assembly under Sections 88 and 89 of the Constitution.
Let me therefore state finally concerning the above and for the records that there was no attempt at anytime to either deliberately mislead the public or conceal any information regarding this transaction; and also to formally apologise for whatever tension or perception of same as a result of the foregoing. On that note therefore, I stand before you as the Minister of Aviation, a citizen of Nigeria and one of your constituents and affirm the foregoing clarifications.
“The second category of my traducers are the entrenched interests in the aviation sector who, for over 38 years have held the sector by the jugular and refused to allow any meaningful development and change take place. For the over 38 years that our airports were a damning commentary on our status as part of the civilized world; or when our airspace existed without the requisite
navigational equipments and facilities to make the airspace safe; these category of persons saw no evil and heard no evil while they happily clapped their ways to the banks! This group has carried on with bitter venom, .. throwing decency and honour overboard, lying and misleading the Nigerian populace even when they knew the truth because my team and I changed the game in favour of Nigeria attaining her pride of place in the comity of nations.
“It is for the first category, the Nigerian people who have acted out of a genuine sense of patriotism, that I seize this opportunity with both hands to let the world know the truth surrounding this matter. For the second category, that is the entrenched, corrupt and profligate individuals and entities who have caused the serious rot in the aviation sector, I owe no apologies; all I owe them is to further inform them that the current generation has seen through them and are no longer willing to tolerate their antics.
“Honourable Chairman, my initial enthusiasm was almost doused when I became aware of what transpired when the Permanent Secretary of the Federal Ministry of Aviation appeared before this Honourable Committee as my representative, with a letter conveying my regards and requesting to present the position of the Federal Ministry of Aviation. I have it on good authority that after his appeal and the presentation of my letter, he was, in the words of some newspaper headlines, “walked out of the House”
“I do not know why the Honourable Committee acted in the manner it did, knowing that the Permanent Secretary is a bona fide Nigerian citizen and therefore entitled to observe the proceedings of his representatives assembled in parliament like any other citizen, more so when the matters being discussed at a “public hearing” are of interest to him. I wondered why this Honourable Committee did what it did: Was there an agenda to harass, cow and intimidate me and ensure that I am unable to state my own side of the story fearlessly? I wondered whether some persons were afraid of the truth being told as it is. ” -
“ I believe that the Honourable House harbours no such agenda. I believe that it was one of those moments when, the false accusations and my trial in the media, had affected the sense of outrage of the Honourable members as citizens of our great nation.. Fortified in this knowledge of the fairness of this Committee, I prepared my presentation knowing that the Honourable Committee will continue to treat me fairly and afford me the opportunity to present it to the Nigerir people without let or hindrance. My humble appeal is that the Honourable Committee will discountenance the blatant falsehoods that have been peddled against me in the media and patiently hear my side of the story.
The Allegations Against Me
“Honourable Chairman, as you are all aware, what necessitated this public hearing were the events that followed a false and malicious online publica—tion that I compelled the NCAA to purchase for me 2 nos BMW bullet proof cars at the cost of USD1.6 Million. Let me state emphatically from the onset that the allegation against me concerning the purchase of 2 nos bulletproof cars for me by the Nigerian Civil Aviation Authority (NCAA) is false in its entirety.
“Your Honours, ladies and gentlemen, our nation is at a cross road in its history. The transformation agenda of Mr. President has changed our ways of doing things significantly. Mr. President recognized the infrastructural deficit in our nation and has taken very bold steps to address this and in order to bequeath to the next generation a nation that can compete favourably in the comity of nations and imbue our next generation with pride and patriotism.
“The massive investment and the aggressive prosecution of this agenda in this regard have seen the aviation sector being transformed. Today, 22 Airports owned by the Federal Government are at various stages of becoming decent and world class terminals. Nigeria’s airspace has become one of the safest in the world with the deployment of modern navigational equipments and infrastructures. The oversight capacity of the whole sector
has been strengthened with the relevant regulations in place and the training and retraining of personnel. Our National Aviation Policy has been reviewed to chart the path to a safer and secure aviation sector. The plan to make Nigeria have a national carrier is at an advanced stage of implementation. The pursuit of an aviation sector that is self sustaining is being pursued with all aggression and vigour.
“All the efforts to L ing change to the aviation sector have been resisted
with vigour by the entrenched interests that have been ripping off the nation. We have had to put our foot down in the national interest and stopped the rape of our national patrimony. We have had to confront frontally very powerful forces that have held the sector hostage. My team and I are not people who will see things going very wrong, fold our arms and complain and not lift a finger to do anything. We dared to act, convinced that it was in the national interest to do so.
“We are not at our destination yet, but Nigerians who are witnesses to the rot of yesteryears are now proud of their nation seeing what is going on in the aviation sector. What we are doing in the sector, together with the effort in other equally important sectors, have given hope to the mass of our people that we can do something, apart from complaining, about the decay in our national life. ;
“In doing what we have done, the purveyors of the rot and corruption that have characterized the sector have at no time folded their arms. They have fought back every inch of the way. The latest false and wicked allegation of purchase of 2 nos bulletproof cars for me by the NCAA is another of the fabrications in their arsenal of lies to discredit my team and make our reformation of the sector lack credibility in the hope that that will clear the coast for them to return to their wicked old ways. But we have only one message for this group: The Nigerian people now know better and will no longer tolerate them!
“ Matters Arising from the Lease Financing Arrangement for Operational Vehicles by the NCAA
Did the NCAA Spend Monies Not Approved by the Appropriation Act, 2013?
Honourable Chairman, the NCAA, as a result of the daily interaction with the law in its regulatory and enforcement roles, is at all times and in all matters conscious of its obligations of complying with the law and all extant rules and regulations of the Government. The NCAA is therefore conscious of its obligations relating in particular to appropriation and will never spend monies that have not been appropriated by the National Assembly.
“It is in this regard, therefore, that the NCAA, within the framework of the Medium Term Expenditure Framework (MTEF) approved by the National Assembly as a planning tool, planned its budget with regard to acquisition of operational and other security and safety vehicles for the next three years in a manner compliant with Section 80 (4) of the Constitution of the Federal Republic of Nigeria, 1999 (as Amended), that prohibits the spending of monies from any fund of the Federation except as appropriated by the National Assembly.
“The media has been awash with the purported spending of monies by the NCAA to the tune of USD1.6 million, N255 million and other figures on the purchase of vehicles by the NCAA. Honourable Chairman, IT IS NOT TRUE THAT THE NCAA HAS SPENT SUCH AMOUNT OF MONEY ON PURCHASE OF VEHICLES, It is also NOT TRUE THAT THE NCAA HAS PURCHASED 2 BULLETPROOF BMW VEHICLES FOR THE HONOURABLE MINISTER OF AVIATION.
“Honourable members, as pointed out above, what the NCAA has done, is to plan for the acquisition of vehicles for the next three years within the MTEF through a LEASE FINANCING ARRANGEMENT with First Bank of Nigeria, Pic. Under this arrangement, NCAA’s obligation to First Bank of Nigeria, Pic is N23 million monthly which will be liquidated in 3 years (36 months). By the end of the year 2013, the total amount the NCAA would have spent on the acquisition of these vehicles will be N116 Million only. This is below the amount of N240 million appropriated by the NASS for the purchase of vehicles by NCAA in the 2013 Appropriation Act. What the NCAA has done within the framework of the MTEF and its desire to be prudent, is to plan its budget in a manner that the cash flow of the Authority
is a1″1′ to accommodate spending effortlessly. The relevant portion of the Approved budget is annexed as Annexure FMA “1″.
Justification for the Lease Financing of the 2 Nos BMW Cars
“Honourable Chairman, the NCAA owes its very existence to the benevolence and wisdom of the National Assembly expressed through the making of the Nigerian Civil Aviation Act, 2006. As the regulator of the entire aviation industry, the NCAA, pursuant to powers granted under the Civil Aviation Act, 2006 makes and enforces Regulations towards ensuring safety and security of Nigeria’s airspace. The NCAA in addition, plays a pivotal role in carrying out Nigeria’s international obligations and responsibilities.
“NCAA has done this with distinction over the years ensuring that Nigeria currently has attained the coveted Category One certification of the U.S FAA; Nigeria is currently a member of the ICAO Council with the strong probability that a Nigerian may emerge the President of the ICAO Council in a matter of days, hopefully by the end of the month of November, 2013 and on the 6th of December, 2013, both the outgoing President and incoming President of ICAO will be in Nigeria. The aggregate of the various victories of Nigeria in the international arena, including the re-election of Nigeria as a non-permanent member of the UN Security Council, is that Nigeria is increasingly readdressing the negative perceptions about our nation.
“The inadequacy and unreliability of NCAA existing operational vehicles due to old age and depreciation necessitated the acquisition of the new ones. Furthermore, with the appointment of a new Director General, Directors, General Managers and other Management Staff there was the need for additional operational and service vehicles. Moreover, the fact that NCAA, as the regulator of the industry, often plays host to dignitaries from ICAO, IATA, US FAA, AFRAA, AFCAC, BAG, CANSO, ACI and a host of others made it imperative to have various specifications of operational vehicles including the purchase of the 2 nos security/safety vehicles. Certification is a continuous exercise in aviation and surveillance is a part of the daily operations of the NCAA.
“As pointed out above, Nigeria is an important player in ICAO circles and Nigeria’s emergence as a member of the General Council has increased the expectations in international aviation. Most importantly, the expected emergence of a Nigerian as the President of the General Council of ICAO will make Nigeria one of the most significant destinations for actors in the international aviation sector. This will place additional burdens on us as a nation.
“It is all these factors that the NCAA considered in planning for the acquisition of the different specifications of vehicles through a Lease Financing Arrangement. The security challenges in Nigeria today are known to all and the efforts and concern of government at all levels towards tackling this have been very glaring. However, while government is tackling the matter, the impact of an attack leading to the death, kidnapping or other injuries to international aviation actors in international circles will simply be disastrous. In addition, matters of insecurity do not wait until you have the resources to fight them before they occur. It requires proactive interface and preventive measures.
“The NCAA considered that it will not be in the interest of our nation if the security issues above were to occur and so ought to be avoided at all cost. The NCAA acted with the highest patriotic consideration within the ambit of the Law and the Constitution.
“Did NCAA Purchase 2 Nos Bulletproof Vehicles for Me as the Honourable Minister of Aviation?
“Honourable members, another falsehood in the public domain relating to this Lease Financing Arrangement is that the NCAA purchased two bulletproof vehicles for me as the Honourable Minister of Aviation. This is TOTALLY FALSE. The 2 nos security/safety BMW vehicles which the NCAA acquired are for security and safety as appropriated by the NASS in the 2013 budget in Item 6. The title documents which are in the names of NCAA/FIRST BANK PLC, as well as spare keys of all the vehicles purchased under the lease financing arrangement are currently with First Bank of Nigeria, Pic as is the case with such arrangements and best practice.
“Honourable Chairman, in addressing the issue of authorization by the NASS as contained in Item 6 of the budget, we invite your honours to consider the narration. In the narration, your honours will observe that the 2 nos security/safety vehicles are provided for distinctively. They are separate from the other vehicles listed. The legislative process, including the process of appropriation, involves a lot of explanations by the beneficiaries of legislative powers in that regard, but when the explanations eventually find merit and is passed, all that happened preceding the passage of the Law cannot be the basis of any meaningful discussion.
“There was nothing in the approved documents reflecting my name, when the budget was being made. At no time did I ever request for any vehicle from the NCAA. It was the agency that had the need and made the request to the Federal Ministry of Aviation. After the purchase on a 3 year Lease Financing arrangement, the vehicles were never delivered to me. The vehicles were also not registered in my name but that of the agency.
“Your Honours, I draw attention to this fact because of the erroneous belief in some quarters that, because in the course of the NCAA defending its budget proposal for 2013, it had to return to the NASS a few times to explain their proposal, therefore the purchase was never appropriated. That is false as the budget is before the Nigerian people and as pointed out, 2 nos security/safety vehicles were appropriated by the NASS.
“Honourable Chairman, on the procurement procedure for the lease arrangement for the acquisition of the vehicles, let me reiterate that the NCAA followed the due process required by law. As we gather here today, there exist no guidelines issued by the Bureau for Public Procurement (BPP) on lease financing arrangements. Despite this lacuna occasioned by the absence of such a guideline, the NCAA followed the due process by involving all the Banks in Nigeria. The Federal Ministry of Aviation under my watch has always been mindful of the need to ensure that we act in a prudent manner and within the ambit of the law and this can be testified to by the tremendous transformation that has occurred in the sector in the last 2 years.
“Specifically, I wish to draw the attention of the Honourable Committee to
the procedure adopted by the NCAA in procuring the operational vehicles:
*On the 15tl] of April, 2013 an official letter was written by the NCAA requesting for approval to procure operational vehicles through Lease Financing. The NCAA’s letter is annexed herein as Anncxure FMA
*On the 25th of April, 2013 approval was conveyed to NCAA for the
acquisition of operational vehicles through Lease Financing, The letter annexed is Annexure FMA “3″.
*On the strength of the above letter of approval, the NCAA got the list of all Banks in Nigeria on 7th May, 2013 and circulated a Request for Expression of Interest on the financing of the lease. The letters to all the Banks requesting for Expression of Interest (EOI) are annexed as Annexures FMA “4 – 22″.
*On 24th May, 2013 the Request for Expression of Interest (EOI) was publicly opened. Three Banks submitted proposals.
*The Evaluation of the Expression of Interests was held on 31^ May, 2013 during which First Bank Pic, Union Bank Pic and Stanbic IBTC responded.
*On the 10th June, 2013 the above three banks were invited to submit Financial Proposals. Thereafter, First Bank of Nigeria, Pic emerged the highest rated responsive bidder.
*Between 20th and 25th June, 2013 NCAA received invoices from various accredited motor vehicle dealers during which only Coscharis Motors Limited quoted for BMW Bulletproof Vehicles. Copies of the invoices are attached as Annexure FMA “23 – 42″. ;
*On 28th June, 2013 NCAA Parastatal Tenders Board approved the selection of First Bank of Nigeria, Pic for the Lease Financing as well as Metropolitan Motor Vehicles and Coscharis for the supply of the vehicles.   This approval was predicated on the due process documentations done by the NCAA.
*On 1st July, 2013 the NCAA sought the approval based on the invoices and the final negotiations with the financing Banks.
*Based on the outcome of the negotiations as contained in the invoices from the Banks, on 5th July, 2013 the approval of the Federal Ministry of Aviation was conveyed to NCAA. The letters dated 5th July, 2013 is annexed as Annexure FMA “43″.
*I am aware that between 8th July, 2013 to 121’1 August, 2013 various meetings were held with First Bank of Nigeria, Pic and necessary documentations were carried out A copy of the Letter of Offer of Credit Facility containing the terms of the relationship dated 30th July, 2013 is attached as Annexure FMA “44″.
*On 13th  August, 2013 the suppliers of the vehicles were contacted at the instance of First Bank of Nigeria, Pic.

Twenty five pupils of Ogba Junior Secondary School, Lagos, collapsed yesterday after inhaling chemical waste allegedly discharged into the drain by Bizcircuit Photo Laboratory, situated at the Ogba Shopping Plaza, Lagos.
The incident occurred around 12:40pm shortly before the close of school.
The school authority and parents ran to the scene. Officials of various state emergency management agencies converged on the scene and rushed the unconscious pupils to Blue Cross Hospital and the Lagos University Teaching Hospital (LASUTH).
Head of Logistics, Lagos State Emergency Management Agency (LASEMA), Mr. Femi Giwa told reporters that four of the pupils were in critical condition, but they are responding to treatment.
He said the agency received a distress call from the school and responded immediately.
Giwa said on arriving at the scene, his team discovered that liquid chemicals with offensive and choking odour was stored and use for production in the photo lab on the first floor of the shopping complex.
He said the odour permeated the environment and led to the incident.
Giwa said the government sealed the premises and arrested three workers of the photo studio.
He said the chemical would be analysed to know its effect on the environment.
State Director of Fire and Safety Services Rasaq Fadipe said his men worked with other agencies to curb the spread of the chemical fumes.

The fight appears to have been between drug peddlers from the African country and an Anjuna-Chapora-based gang of Goan drug peddlers. According to sources, the attack was the fallout of a recent drug bust where an African national was nabbed in Panaji by the Narcotics Control Bureau with cocaine worth over Rs1crore.

On Thursday, the body of Obodo Uzoma Simeon lay at the spot in an alleyway between two houses in Lobowaddo till 11.40am as around 150 Africans, including Nigerians and Kenyans, demanded that the police, who had arrived at the scene around 7.15am, immediately arrest the alleged accused and attempted to prevent the police from taking away the body.

The presence of the largely burly foreigners and the initial few numbers of the police personnel created a panic-like situation in the locality. The Africans threatened to take the law in their hands if the murderers were not arrested. Finally, after a lot of arguments with the police, and with an enhanced force from several police stations now at the spot, the police were able to conduct the panchanama and take the body in a hearse van towards the Goa medical college.

According to some African eyewitnesses, the attack started around 11.40pm on Wednesday when some alleged drug peddlers from the Anjuna-Chapora coastal area drove to an area in Parra where some Africans had gathered and attacked them with choppers and knives. The locals arrived at the spot in three cars and around 10 motorbikes.

As the Africans attempted to flee on their motorcycles, they were chased by the gang from Anjuna-Chapora. The murder victim had his right hand chopped off with a chopper as he was riding a two-wheeler and was later hacked to death as he attempted to flee on foot. Five other Nigerians suffered stab wounds, some of them serious. Two have been admitted to a hospital.

"We are angry at how the local people and the police are not doing anything tangible despite us having provided them details of the assailants," a Nigerian at the spot told TOI. One of them suspected that the local drug peddler from Chapora has the backing of some senior politicians.

Calangute MLA Michael Lobo, who resides close to the spot of the attack, said, "The clash probably occurred over control of 'territories'. Around 150 Nigerians gathered and challenged the police to take away the body. This is just the tip of the iceberg. The Africans are controlling the cocaine trade in Goa. More than 150 Nigerians are staying in Parra. What are they doing here? They say they're students and are registered with an open university in Pune. They come to India on student visas, register in Pune, and then come to Goa to sell drugs. The Goa government needs to enact a law to prevent these people from staying here. Only foreign students registered with a Goan institution should be allowed here, not students registered in other states."

The body was found near the residence of local Bharatiya Janata Party (BJP) legislator Michael Lobo, who said his constituency was a victim of a drug war and that the murder was linked to narcotics trade.

"I have been saying this over and over again. Goa is in the grip of a drug mafia. This murder is a narcotics murder. The police are very lax," Lobo said.

A legislative committee report tabled in the state assembly earlier this month clearly pointed out to a police-politician-drug mafia nexus operating in Goa. It names several politicians as well as police officials who are alleged to have links with the narcotics mafia.

Oduah who astonished stakeholders with this disclosure at the investigative hearing on the issue in her 12 page presentation said: “As you all are aware, what necessitated this public hearing were the events that followed a false and malicious online publication that I had compelled the NCAA to purchase for me 2 nos BMW bullet proof cars at the cost of $1.6million. ”

She said the money NCAA would pay would still be below the N240million at the end of the year. On whether she acted within the ambit of the law in giving approval beyond N100 million , she said she approved the money and asked the NCAA to do the needfull. What is the needfull? The PS claimed that due diligence ought to have been done by the agency before applying for the approval. He claimed that he was not available at the time everything happened . The DG said he would have followed the procurement Act if he were the one the directive was given to do the needfull. He said the acting DG Joyce Daniel Nkemakolam ought to explain why he did not do that. Nkemakolam said we interpreted the directive to mean to go through it in line with the procurement Act. He said they did the due diligence but they had a mindset that they were within the budget limit. But he was asked why he didn’t do due diligence to ensure that it was in tandem with the procurement law, he said he thought since the agency had got the approval of the National Assembly there was no need for such diligence. He was asked why he initiated a memo to approve 54 vehicles when what the National assembly approved was 25 vehicles. He was reminded that what was approved was N240million and not N643million. NCAA was asked whether the board sought approval of the president to approve the car loan. Nkemakolam said he was working on the mindset that they were still within the approved limit. He said that what NCAA discussed with First bank was a lease. He was asked the date the board of NCAA approved the loan facility. The DG was asked how many trainings did he organise for NCAA staff , he said he relied on experts. He said that his mindset has always being that they did not exceed the amount approved. He was asked whether the NCAA board approved the money. He said the NCAA has interim board. He said that he was working on account that it was a lease not loan. The drama continued with Rep Manwe asking the former DG of NCAA to disclose who uses the controversial bullet proof cars since the Minister bluntly confessed that they were not bought for her use. “Who is using the vehicles now since the Minister said they were not purchased for her?” he asked. To the DG, that was one question that got him jolted. Minutes passed before he could provide an answer. And when he finally found his voice, he said “Anybody can use the vehicles when they are in the pool. They are operational vehicles.” But the Lawmaker wouldn’t give up. He continued with a rider to the question. “Do you mean that a messenger or cleaner in the agency can use the cars?” He asked. At this juncture, the hearing room became deadened in silence with the DG losing his voice for the second time. And when again, he found it, he answered this way: “those categories of vehicles are for VIPs which include the Minister, including you, the Honorable.” Just then a blast of laughter erupted in the hall which to some extent provided some comic relief to everyone in the hall. But Rep Manwe wouldn’t stop. He asked again, “can we have the log book of the movement of the car? With a subdued babbling voice which came in separate minutes, the DG answered ” I am not a transport officer. I don’t know whether they are still keeping those log books.” When it now became obvious that the DG was exhaustive of all the answers he had, the Lawmakers mandated the agency to bring the man who received the vehicles at the point of delivery by Coscharis Motors. With that, the hearing came to a close. In her closing remark, the chairperson, Onyejeocha assured Nigerians that justice would be done to the report of the hearing. “Fact speak for itself. We have tried to listen to people: Coscharis, the Minister, NCAA, First Bank , BPP and Customs, and we have their submissions with us. We will consider what we have whether it is in line with the extant laws and financial regulations. We assure everyone and all Nigerian that we will do justice to this hearing,” Onyejeocha said. Speaking with some Journalists shortly after the hearing, the Minister, Oduah expressed gratitude to the National Assembly for giving her an opportunity to present her own side of the story.

LAGOS — The Economic and Financial Crimes Commission, EFCC, have arrested a suspected teenage internet fraudster, Tobechukwu Igbokwe, and his accomplice, Ifeanyi Obi for allegedly defrauding an American of $40 million.
The suspects, who were arraigned before Justice Lawal of a Lagos State High Court, Ikeja, on a 12-count charge bordering on forgery, conspiracy and obtaining money by false pretences contrary to Sections 8(a) and 1(3) of the Advance Fee Fraud and Other Fraud Related Offences Act No. 14 of 2006, were remanded in prison custody pending their bail hearing.
Igbokwe, 19-year-old secondary school leaver, was alleged to have duped his victims, many of them foreigners, of huge sums through the internet under fraudulent guises.
He allegedly worked in concert with Obi to dupe an American, Micheal Silva, of $40 million in an inheritance scam.
Silva was made to believe that Igbokwe and his accomplice had a huge inheritance that they wanted to move to a foreign account for safekeeping.
The victim was asked to send money to “process” the transfer and in the process, he wired $40 million in installments through Western Union Transfer to Igbokwe and Obi.
Other victims
Igbokwe also confessed that he had duped other foreigners among them a Tommy Bedwell, who lost $6,000 to him and Richard Hunt, $15,000.
One of the charges against Igbokwe and Obi read: “Tobechukwu Igbokwe (alias David Prince, alias John Emma, sometimes in the month of October 2011 in Lagos, within the Ikeja Judicial Division, with intent to defraud, obtained $800, $700, $200, $400, $200, $300, $500, $500, $500, $200 (totaling $5,500).
“Which sum you obtained separately from Michael Silva of the United States of America under false pretence that the money represent part payment for processing inheritance funds due him as a beneficiary of the fund and which pretence you knew was false.”
When the charges were read to them, the defendants pleaded not guilty.
EFCC counsel, Fadeke Giwa prayed the court for a trial date and to remand the accused persons in prison custody.
However, counsel to the first defendant, D. A. Omougbai, asked for a short date to file his bail application.
Also, counsel to the second defendant, D. A. Eimuejel, prayed the court to accept the bail application he filed on behalf of his client.
Justice Akapo, however, adjourned the matter till December 3 and ordered that the defendants be remanded in Kirikiri Maximum Prison, Lagos.

The paramount ruler of Esit Eket Local Government Area of Akwa Ibom, Chief Ubong Assam, has been freed by his captors.
Chief Assam was kidnapped about 10 days ago by gunmen who took him to an unknown destination and demanded N150 million as ransom.
The kidnappers were upset over the reported hijacking of oil spill compensation funds accruing to Esit Eket from ExxonMobil.
The funds, over N200 million, were used to refurbish the palace of the monarch, who doubled as the contractor, rather than the intended community development.
The hoodlums later reduced the ransom to N50 million but gave a one-week ultimatum for the money to be paid.
A source who was part of the negotiations that led to Chief Assam’s release said the hoodlums collected N15 million.
The source, who confirmed the freedom of the traditional ruler to SaharaReporters today, said the paramount ruler was in a sound and healthy state, adding, “As I speak, I am with him and his family members.
“We are very happy to see our paramount ruler back in Esit Eket,’’ the source said.

Police operatives in Lagos have arrested three persons and declared one other wanted for allegedly gang r*ping a girl to a state of coma. The young girl, simply identified as Vivian, is battling with death in a private hospital in Ikorodu area of the state.
Crime Watch gathered that the 15-year-old secondary school girl had gone to collect lesson notes from her colleague, Tabiola.
Tabiola was alleged to have lured her to a place where three others were waiting to devour her virginity.
A police source told Crime Watch that as soon as Tabiola walked in with Vivian, the suspects locked her inside a room where they forcefully stripped her n*ked.
According to the senior police officer, the girl was gang r*ped and was abandoned unconscious in the pool of her own blood.
The police officer, who gave the names of the three suspects as Yusuf, Rasheed, Oyedepo said, “When it dawned on the suspects that the girl was unconscious, they abandoned her in the pool of her blood where she would be seen and fled from the community. I believe that the evil guys did not expect the girl to survive.
“Anyway, as the case is, it will take the grace of God and good medical attention for the girl to survive and be normal again. Her pelvic, according to doctor’s report, has been so battered. She was badly injured and she lost too much blood. More so, the girl was a virgin and was forcefully deflowered. I feel for her because she is so devastated and psychologically traumatised.”
Lagos State Police Public Relations Officer (PPRO) Ngozi Braide who confirmed the story told Crime Watch that the victim is a Secondary school girl. “She was lured to the place where she was gang r*ped by four men. She is presently recuperating in a private hospital.
Her condition was very bad as she was abandoned unconscious in the pool of her own blood.
“We have arrested three suspects and one other is still at large but we have declared man hunt for the fleeing suspect.”
She warned young girls to be wary of the male friends they keep as friends as some of them may be worse than beasts. “Don’t visit your male friends alone and even when you go in company, don’t follow your male friends inside the house or a secluded areas,” she advised.

The Minister of Aviation, Ms. Stella Oduah, has denied reports that the two BMW armoured cars, bought by the Nigeria Civil Aviation Authority from Coscharis Nigeria Limited, were bought for her.
Appearing before the committee looking into the crisis in the aviation industry, especially the purchase of the armoured cars, Oduah said the controversial cars were meant for the safety of aviation visitors to the country.
She claimed the NCAA bought the cars for the safety of foreign aviation visitors in line with Nigeria’s growing role in AICAO certification.
“It is totally untrue that NCAA bought cars for me.
“They were not registered in my name”, she said
Meanwhile after a long wait by the committee members and the press, the minister arrived at 11.42am, about one hour 42 minutes behind the scheduled 10am for the session to testify before the committee.
She came a few minutes after the committee members, led by the Chairman, Mrs. Nkiruka Onyejeocha, arrived the venue.
The minister, who wore a stripped blue ankara dress with a matching blue head scarf, walked into the hall at 11.42am
Oduah also wore white beaded jewellery to complement her embroidered blouse.
She took a sit facing the panel members. But, shortly after, she rose, went halfway between her seat and the high table, where she exchanged pleasantries with the committee chairman.
Oduah walked out of the hall before returning again to resume her seat.

ABUJA — Former President of the Court of Appeal, Justice Isa Ayo Salami, who was suspended from office by the National Judicial Council, NJC, over alleged judicial misconduct, yesterday, said he has handed over the erstwhile Chief Justice of Nigeria, CJN, Justice Aloysius Katsina-Alu to God, for not only lying against him, but also for his alleged attempt to pervert the course of justice.
Salami, who finally opened up  on what actually transpired between him and the ex-CJN, leading to his suspension on August 18, 2011, maintained that he has no regret for any action or judgment he delivered while in office, saying “a judge must, above all, stand taller than the pressure that he would continuously face in the exercise of his duties.”
Speaking at the official presentation of a book entitled ‘Isa Ayo Salami: Through Life and Justice’,  in Abuja, yesterday, the former PCA, however, regretted that he was unjustly treated by the NJC despite the fact that he spent about 45 years of his life in active judicial service for the country.

The Nigeria Police has described the photograph, which showed a senior police officer in the act of fondling the breast of an unknown lady, as fake. It said the picture, which went viral on the Internet, was deliberately fabricated with the aid of Adobe Photoshop technology to mislead the public.
The alleged amorous scene, the police authorities claimed, did... not take place and the officer had nothing to do with the woman.
The police said it arrived at this conclusion after interrogating the policeman, who was seen in the type of uniform worn by officers of the rank of Assistant Commissioner of Police.
On the official Facebook page of the police, the affected police officer was quoted as saying, “I don’t know this lady. I never took the picture with her.”
However, the authorities did not name the police officer nor give the details of the command where he is serving.
The police said that though it does not forbid its rank and file to pose with members of the public for photographs, it would not tolerate any display of affection for the opposite sex in full public glare.
“An image showing one of our officers in a compromising position with a lady has gone viral. Please check the hands in the so-called picture that is in circulation and you will agree that they were photo-shopped.
“Other citizens of this country are encouraged to pose for snapshots with our uniformed officers if they so desire, just as it is done worldwide. What we discourage is public display of affection by our uniformed officers,” it said.
After it appeared online, the controversial photograph provoked widespread condemnation from many Nigerians who have described the development as an act of indiscipline.
Claiming to be policemen, some people wrote on the police Facebook page that the phot0graph was the handiwork of mischief makers, who were clearly determined to drag the name of the security agency in mud.
They said that no uniformed officer of the rank of ACP would be so careless as to pose for a photograph in such a compromising position with a lady.
One Oluwasegun Samuel-Alalade commented on the wall of the Facebook page. “I know it is not real. Even a fresh recruit undergoing training at the Police College will not do such a thing, not to mention a top ranking officer. The Nigeria Police Force should kindly disregard the photograph, “ he wrote.
Also Kabiesy Ojeabulu wrote, “Photoshop or no Photoshop, all I have to say is that the Inspector General of Police, Mohammed Abubakar, should always investigate issues before taking actions. It appears that a large section of the general public does not like the police. So they fabricate anything to tarnish our image. God help us all.”
Another policeman, Adegbola Olafiyin, stated, “I don’t know the offence we committed to deserve this from the public. Imagine here in the state where I am serving, commercial motorcycle riders will not give you a ride despite the fact that you have your money. This whole thing amounts to blackmail.”
But some Nigerians have disagreed with the police authorities on the status of the controversial photograph. They insist that it appears more real than fabricated.
On cknnigeria.com, one Lanre Bewaji wrote: “There are many angles to this picture. It is obvious the lady took the picture and the officer consented to it. No matter how awkward the scenario looks, if the lady was his wife or fiancée, would there be an issue? Until we know the real circumstances behind this picture, the matter is neither here nor there!”
In a tweet to the police, Hyke Ekeanyanwu expressed doubt that the photograph was faked. He said, “I may agree that the hand holding the breast was photo-shopped, but I will not agree that the hand around his (police officer’s) neck does not belong to the lady.”
Wale Bolanle, also on Facebook, queried,“What do you want us to believe? What else do you want him to say? He must surely deny. Is he not a human being?”
Meanwhile, the police authorities may have drawn the battle line with commercial banks in the country over the non-payment of the salaries of policemen.
The Force Headquarters wrote on its Facebook and Twitter handle on Wednesday that then Inspector-General of Police, Mohammed Abubakar, was “angry” with the banks over the matter.
“IGP MD Abubakar, is angry with bankers over delay in payment of Police salaries,” the message read.
Lamenting the situation, one Samuel Dogo, wrote, “The police authorities have allowed the commercial banks to deal with us the way they want because there is no proper monitoring. Nobody wants to know whether we have families and other dependants that are looking up to us for their upkeep.
“The police has the highest rates of deaths and causalities among security agencies in the country. In spite of our tireless efforts to protect the lives and properties of Nigerians, we are not appreciated. We earn the least salaries. Yet, we struggle so hard to ensure that this money is paid at the right time. If I may ask, is it a curse to be a policeman? I don’t understand. Can someone help me with a reasonable explanation?”

A medical personnel believed to be a doctor has been arrested by the men of the Benue State police command for raping a female patient who was on admission in a hospital where he practices.
The alleged rapist (name withheld), is a medical practitioner with Tersoo Clinic in Naka town, Gwer West local government area of Benue state.
It was gathered that the medical personnel reportedly tested positive to HIV/AIDs and was receiving Anti-Retroviral (ARV) treatment at the General Hospital Naka, before the incident.
It was gathered that the female patient was brought to the clinic for emergency medical attention and after been placed on drip, recovered partially, but unknown to the medical personnel, who took advantage of the fact that she was semi-conscious and forcefully had carnal knowledge of her.
The police public relations Officer in the state, DSP Daniel Ezeala, confirmed the incident, saying, “the medical personnel has been arrested by our men in Naka and investigation in the matter is on-going.”

SaharaReporters has learnt that several administrative staff of the Federal Capital Territory have been suspended over a recently discovered fraud whose monetary scope is yet to be determined.
“It runs into millions of naira,” said a source at the FCT which is under the supervision of Bala Mohammed, a member of President Goodluck Jonathan’s cabinet.
So far, the fraud has led to the suspension of six administrative members, most of them from the Abuja Geographic Information Systems (AGIS).
The suspended AGIS staff include Oluwadamilola Temidayo Adetiloye, a planning officer, Wasiu Olatunde Olajide, a program officer, Mohammed Mohammed Saba, a land officer, and Danladi Daniel, a clerical officer. Two staff of the Land Administration Department, Yusuf Baba and Blessing U. Nwiyi, were also affected by the suspensions.
Our source disclosed that the suspended staff members were accused of swindling hundreds of millions of naira from thousands of prospective land owners.
Our source quoted FCT Minister, Mr. Mohammed, as warning that he would not spare staff involved in any acts of fraud. The minister added that the suspensions were meant to serve as a deterrent to others who may be tempted to indulge in fraudulent activities, adding that the law must take its course.
However, one of the victims of the land scams told SaharaReporters that many other FCT officers were involved in fraudulent activities. He added that the minister had no record of prosecuting or even disciplining corrupt staff members

One of the BMW hurriedly taken to the premises of the NCAA yesterday has a different chassis number.

Maduka Cosmos, whose Coscharis Motors sold the controversial armoured cars to a department of the Ministry Civil Aviation, has told the House of Representatives Committee on Aviation the matter that his company followed due process.
Mrs. Stella Oduah, the Minister who is implicated in the alleged fraud, is absent at the hearing, from which Premium Times is carrying live updates.
“Absence of the Minister is a slap on the face of the House,” said an angry Jerry Manwe, a member of the committee from Taraba State.  Last week, the committee gave Mrs. Oduah up till yesterday to appear before it, recognizing that she was away in Israel on official duty.
“To the best of my knowledge, we followed all due process,” Coscharis said.  “We were interviewed by SSS. We were interviewed by the National Security Adviser. Every due process by law was followed. We do business with morality.”
The Deputy Comptroller General of Customs, Manasa Daniel Jatau, has told the committee that Coscharis imported the cars without paying import duties because there was a waiver from the Ministry of Finance.  He added that Coscharis obtained the waiver claiming the armoured cars were part of 300 vehicles being imported for the Sports Festival in Lagos last year.  The impression given, therefore, was that the beneficiary of the waiver would be the government of Lagos State.

The cars inspected by the House committee yesterday, Tuesday, are different from the ones stated in the documents between NCAA and Coscharis, the reps said.
Lawmakers say they saw cars with different chassis number from those on the communication between NCAA and Coscharis.
But Coscharis said since it did not inspect the cars with the House members, it cannot say whether that was the car they delivered to NCAA. The firm insists it has done no wrong.

But a lawmaker has confirmed that he received a quotation from an American firm for the same car for about N42 million.

The vehicles were cleared 19/6/2013.
Coscharis imported the cars without paying import duties since there was a waiver from the ministry of finance.
Coscharis obtained the waiver claiming the armoured cars were part of 300 vehicles imported for the Sports festival in Lagos last year, and therefore the beneficiary was Lagos state government.
The due import duty should have been N10.1 million.
The cars had an End User Certificate from the NSA office in the name of Coscharis.
The waiver obtained by Coscharis was for one year; as such the time of importation this year was covered.
Customs admit its laws requires that it enforces duty on any item for which waiver was obtained, which was not used for the purpose stated-in this case, for Sports festival.

Nigerian Customs confirmed that the two cars were imported and cleared at Tin Can 2.
The Customs said the import duty on the two cars which should have been N10 million plus were not paid because there was a waiver note issued by the finance ministry.
Customs also confirmed there was an End User certificate issued by the office of the National Security Adviser, NSA.
