A Federal High court yesterday ruled that an on-line suspected
terrorist, Muktar Ibrahim [aka Abu Sabaya] must answer charges of
terrorism brought against him by the Federal Government.
The court consequently ordered that he be remanded in prison custody pending the determination of his case.
He was said to be an on-line personality who was celebrating the bombing campaigns of the Boko Haram sect on the jihadist website and also soliciting for funds from international terrorists groups to fund the activities of the sect in Nigeria.
On the no case submission brought by the suspected terrorist, Justice Gabriel Kolawole held that the prosecution counsel, S.M. Labaran, a senior state counsel from the office of the Department of Public Prosecution [DPP] of the Federation, has established a prima facie case against him.
The court, however, discharged the accused person on two out of the five counts-charge of terrorist activities brought against him.
Ibrahim, a first class graduate of Mechanical Engineering from the Ahmadu Bello University, Zaria, was said to have registered his email address banatsuad1@yahoo.com on a jihadist website www.ansar1.info and posted messages on the activities of Boko Haram in the country, contrary to the provisions of the Terrorism Prevention Act, 2011.
Some of the charges against him that were sustained by the court include the following:
*That you Murktar Ibrahim [m], a.k.a Abu Sabaya of Area G. ABU Quarters, Samaru, Zaria, on or about 7th February 2012 having registered your email address banatsuad1@yahoo.com on the jihadist website www.ansar1.info did receive a message on the website to wit “…is there any way we can help the mujahahiden in Nigeria by AMEF projects? We are ready to release videos, statement and other material to support our brothers in Nigeria” being a message preparatory to an act of terrorism and you thereby committed an offence contrary to section 1[1] [a] of the Terrorism [Prevention] Act, 2011 and punishable under section 33 [1] [a] of the same Act.
* That you Murktar Ibrahim [m], a.k.a Abu Sabaya of Area G. ABU Quarters, Samaru, Zaria, having registered your email address banatsuad1@yahoo.com on the jihadist website www.ansar1.info on or about 16th June 2011 did post a message that reads “The wind of rage has been unleashed upon the battalion of the tawaghit and all their allies in Nigeria in a successful attack a severe attack and damage at the heart of the security apparatus of the Nigerian government, the Muwahhidin with the assistance of Allah were able to deal a great blow to the government and also to prove to their masters in the White House that our call is based upon actions rather than speech.
“Many Nigerians were very happy about the blast because they are frustrated by the tyranny of the tawaghit and their hijacking of the country’s resources for their selfish interests.
“This attack is indeed a success because prior to the attack, the Nigeria Police Force on behalf of the Inspector General of Police, Hafiz Ringim boasted and vowed that the days of the Mujahhidin in Nigeria are numbered, little did he know that the Mujahhidin are on their way to his palace in Abuja.
“Also from the scenes of victory is a report of another bomb blast at Maiduguri that also killed these filthy tawaghit and their emissaries, so now the message will be clearer. Nigeria definitely is a major front of operation for the call to jihad. The newly elected taghut has also vowed to deal with the mujahhidin and in the history of any African country he was the first to propose the establishment of a ministry of Anti-Terrorism and also signing of the ECOWAS counter-terrorism strategy.
“So the situation is now clear and the battle line has been drawn. Our only prayer is that the Muslim Ummah should show appreciation and allegiance to our beloved mujahhidin whose efforts is to revive our lost caliphate and also to serve as a vanguard that will free the Muslim Ummah from the oppression of the local tawaghit in the Aso Villa and their kafir paymasters in the White House.
Another charge reads: That you Murktar Ibrahim [m], a.k.a Abu Sabaya of Area G. ABU Quarters, Samaru, Zaria, having registered your email address banatsuad1@yahoo.com on the jihadist website www.ansar1.info on or about 4th November 2010 did post a message that reads “The aftermath of our brothers attack on the prisoners of the tawaghit in Bauchi and Yobe state has geared the tawaghit to deploy a new method of harming the Muhahhidin.
This time they have pledged a sum of N500, 000 for anybody who can provide information about the safe houses of the Muhahhidin coupled with their employment of a joint coalition of the tawaghit forces. As for the media productions of our brother insha Allah we are rigorously working on them.
First they are in Hausa Language which means we must translate them before posting them but we are promising the forum members that they should exercise patience with us we are seriously lacking expertise which is presently harming our efficiency. Jazakallahut” being a message constituting act to promote an act of terrorism and you thereby committed an offence contrary to section 1 [1] [b] of the Terrorism [Prevention] Act 2011 and punishable under section 33 [1] [a] of the same Act.
Further hearing on the case has been fixed for May 12 and 21 respectively.
